Federal Court Orders Freedom of Abrego Garcia from Immigration Detention
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The case stems from a erroneous deportation to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to face human smuggling allegations, he was held in federal detention.
In her order, the judge noted that the authorities does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."

The court challenge center on disputed assertions. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this allegation.
